This Just Is Not Right

I know this is not remotely firearms related, but as a Veteran, I have to say something.

A United States Court of Appeals has just overturned the conviction of a man convicted under the Stolen Valour Act of falsly saying he had been awarded the Medal of Honor. The Court states that The Stolen Valour Act violated the defendents right of free speech under the First Amendment.

The defendent, a Mr Alverez, is in jail, however on a charge that he defrauded a Water District. You don't pay the water bill, you go to jail. You steal the Honor of those that have gone above and beyond duty in Combat Situations, it's OK.

Somebody needs to take Mr Alverez outback and beat the Sh-t out of him..........jackie
 
Absent that, I would like to see a picture of him on the cover of every newspaper, magazine, and a TV news story, including his picture an particulars run on all the stations. This is one more example of an activist court legislating. I guess we all now have a federally defined "right to lie"....with impunity. What a crock!

If there wasn't a federally defined "right to lie"....with impunity, we wouldn't have a Federal government :) :)
 
Gentlemen ...

Complaining rhetoric amongst a small group does no good, except help vent your spleen, if your spleen needs a good venting. The best way to make decisions like these right is to get yourself appointed to one of the 3 judge panels in the United States Appeals Court system and then when one of these cases comes up, ensure that all your legal training and powers of persuasion places you on the majority side of the righteous decision. :)
 
Trouble is most honest and working class folks will never have a chance in politics. Corrupt system will wash them out. Just look at what the media does to Mrs. Palin.

There is so much more I could add to this, but it would be negatively political, so I will sum my thoughts up by saying that we never had any of this crap before the 60's., and I am certainly old enough to remember long before that. Everything today is unconstitutional, as if our founding fathers had any idea things would be taken to this extreme.
 
Luckily, the 9th circuit court of appeals is THE MOST overturned court in America because it is loaded with liberal hacks that have an agenda (Just like the gay judge in California overturning what the people voted on). Im sure this will be overturned in the Supreme Court. It does however make me very nervous about this country.

The world is full of pretenders. If you do not have a college degree, make up a college and print a diploma.
It is the same with military service, it is "in" now to have served in the military so we have lots of pretenders. A few of those pretenders want to be thought of as heros so they claim medals won and hardship endured.
People who served in the military and got no medals are still to be admired, they were called or volunteered and did their duty. Military service is one of the things that people do that is an underappreciated job serving other people, while some of the non-servers are complaining about how hard their life is, they don't have a clue.

OTOH, I wonder if it isn't one step from there to a law that makes it illegal to criticize an elected official or even the gov't in general.

They are trying to do exactly that in South Africa right now. A commission appointed by the president to police the acceptability of all media content with the ability to hand down both fines and jail time. Hmmmm. Free speech? Indpendent judiciary?

The first and most important right we have is free speech. I'm just not sure that some things that look absurd on the face of them are not required to keep that right in place.

But it still rubs me the wrong way.

Don't get too overly concerned with someone who said he had been awarded the Medal of Honor. [I'm a 26 year veteran and I am not.]

Skepticism should be the first reaction along with the raising of a red-flagged eyebrow. The Medal of Honor isn't handed out lightly, and when done, is done with much pomp and ceremony and usually on a national stage. Anytime someone says they have been awarded that particular medal they should be viewed with suspicion because most recipients, if not all, don't go around openly advertising their award. It's the braggadocio's desire to gain fame or recognition that's usually at the heart of most boosts.

Although there is no correlation with the above falsified act, here is a true story I remember well. Read it from beginning to end [all three segments]: http://www.arlingtoncemetery.net/borda.htm.

Because someone called into question a combat "V" which Admiral Mike Boorda wore on his uniform, and a media report claimed he was probably not entitled to wear, the outcome was tragic. In the end it was later determined that he had, indeed, earned the devices and the ending should have turned out differently. Why it didn't is anyone's guess.
 
Although it may be common, I think it's sad that people "puff" their resume. I also think Big Brother tries to put ridiculous restrictions on "we the people." I find some comfort in knowing that a court can declare a law unconstitutional; it will be interesting to see if this case gets to the Supremes.

BTW, isn't it great that we live in a country where the gov't will defend you against that very same gov't.
 
Gotta agree with Jackie, but figure that this guy would need a whole crew to beat the crap out of him since he's obviously full to overflowing.

If this travesty of a decision is upheld by SCOTUS then maybe the picture of scumbags who do this sort of thing should be widely published, and whatever reputation he or she had totally destroyed. The alternative would be the formerly popular sport in Belfast, No Ireland, no kneecaps or at least ones that operate properly. And people say I'm mean and have a bad attitude about some things.
 
Take him down to a biker bar full of vets and tell them what he did and then leave. Ill post an example of this in the next square if it will let me.

Simply expose the man.

Those heros who have been awarded The Medal of Honor make up a short list. Many have died in the process of winning that honor. Someone who lies about having been awarded the Medal of Honor does not diminish the honor of those few who have won it. They only diminish themselves. There is no fitting punishment any earthly court can issue that is worse than the scorn of his fellow men who know what he has done.

We need more gatherings where the idiot activists are given warm, moist, aromatic welcomes like this one.This is why PETA usually protests women wearing fur rather than bikers wearing leather. Sounds to me like the old saying, "you mess with the bull, and you get the horns". Johnstown, PA (GlossyNews) - Local and state police scoured the hills outside rural Johnstown, Pennsylvania, after reports of three animal rights activists going missing after attempting to protest the wearing of leather at a large motorcycle gang rally this weekend. Two others, previously reported missing, were discovered by fast food workers "duct taped inside fast food restaurant dumpsters," according to police officials.

"Something just went wrong,"said a still visibly shaken organizer of the protest. "Something just went horribly, horribly, wrong."The organizer said a group of concerned animal rights activist groups, "growing tired of throwing fake blood and shouting profanities at older women wearing leather or fur coats," decided to protest the annual motorcycle club event "in a hope to show them our outrage at their wanton use of leather in their clothing and motor bike seats." "In fact," said the organizer, "motorcycle gangs are one of the biggest abusers of wearing leather, and we decided it was high time that we let them know that we disagree with them using it. ergo, they should stop."

According to witnesses, protesters arrived at the event in a vintage 1960's era Volkswagen van and began to pelt the gang members with balloons filled with red colored water, simulating blood, and shouting "you're murderers" to passers by. This, evidently, is when the brouhaha began.

"They peed on me!!!" charged one activist. "They grabbed me, said I looked like I was French, started calling me 'La Trene', and duct taped me to a tree so they could pee on me all day!"

Still others claimed they were forced to eat hamburgers and hot dogs under duress. Those who resisted were allegedly held down while several bikers "farted on their heads."

Police officials declined comments on any leads or arrests due to the ongoing nature of the investigation; however, organizers for the motorcycle club rally expressed "surprise" at the allegations.

"That's preposterous,"said one high-ranking member of the biker organizing committee. "We were having a party, and these people showed up and were very rude to us. They threw things at us, called us names, and tried to ruin the entire event. So, what did we do? We invited them to the party! What could be more friendly than that? You know, just because we are all members of motorcycle clubs does not mean we do not care about inclusiveness. Personally, I think it shows a lack of character for them to be saying such nasty things about us after we bent over backwards to make them feel welcome."

When confronted with the allegations of force-feeding the activist’s meat, using them as ad hoc latrines, leaving them incapacitated in fast food restaurant dumpsters, and 'farting on their heads,' the organizer declined to comment in detail. "That's just our secret handshake,"assured the organizer.
