shipping a rifle sold to an individual question

If I sold a rifle to an individual would I be able to ship it to his gunsmith(ffl) as when I ship a rifle for work to be done or do I have to have an FFL holder ship it for me? Thanks
 
With the strong anti gun sentiment around the country at the moment, why take a chance at being prosecuted?
It will cost a little more to use your local FFL holder but that will be a bunch cheaper than defending yourself
from prosecution.

I personally would not take the chance.
 
Shipping to an FFL

It depends on the state. Federal regs allow an individual to ship to an FFL in any state for sale, transfer, or repair. If you live in a free state it is probably OK. States like CA, NY, NJ, MA etc. may or not have restrictions. Also a good to get the receiving FFL's OK as some don't like doing it.
 
I would contact his FFL dealer and talk it over with him. That away you know how he wants it ship and what he needs.
 
Don't take my word for it when it comes to absolutely legality, but I've purchased several out of state guns from individuals. In each case I checked with my local FFL who agreed to accept the gun sent from an individual along with a good photo copy of his drivers license and all the other normal particulars, name, address, phone, etc.
 
Legal or not, I always want a paper trail through an FFL for sale or purchase. Too easy to possibly mess up on some law you don't know about. In New York, under the Safe Act, you can not longer make an incidental sale of a firearm to a friend even within the state. To take the bite out of it, the state legislated a Maximum fee for these in state transfers to $10.00 per transfer. Not all dealers will do it, but I have three in my area that will and for $10.00 it makes me sleep easier.

I would contact his ffl to insure that they are willing to accept shipment from a private individual and what they require. I know that the USPS will allow shipping a long gun to an ffl from an individual.
 
Last year I purchased a BSA Martini in the UK. I had to apply to the ATF to import it =$ then a exporter=$ then a importer =$ then ship to a FFL =$ then he insisted on a background check =$ even though I had it in writing from the ATF that I could have the rifle. Every one wants there pound of flesh.

Ask for a copy of the FFL the buyer is using. Check the FFL is valid on the ATF site, then contact the FFL holder to make sure they know it is coming. Personally, if his FFL agent won't supply a copy, I wouldn't ship it.
 
thank you for the replies. it will only cost $20.00 for me to use an F F L holder on my end so i will do that and get copy of receiving F F L as ballistic64 mentioned. i appreciate the information. i have never shipped one that i sold.

ATFE has cautioned FFLs about supplying an individual with a copy of their license. Thanks to the grand advances in technology, fraud is running rampant with copies of Federal Firearms Licenses as it is most everywhere else. Most FFLs will give the numbers to do an EZ-Check (the first 3 and the last 5 numbers of the license number). This is all that is necessary. Download the "results" page,,,,, this is your bona fides. The EZ-Check wil let you know if the license is valid or not (you should do this when shipping a firearm to a gunsmith for work, too). Assuming EZ-Check shows the license to be valid, ship to the address given on the EZ-Check and that address only, with the receiving FFL holders permision. Keep the shipping receipts along with the EZ-Check "bona fides", staple them together. With these, you have done your 'due diligence' as a citizen. The Federal Firearms license, itself, is for ATFE and for other Licenses. Now, call your local ATFE office and ask them how to handle your shipping 'problem'. They are there to help you with instances like this. The inspectors & investigators I've had contact with over the years have always been helpful and respectful. But, I'd not want to try to "pull the wool over their eyes", either.

By using a FFL on your end, to ship, you will be transfering the firearm to the FFL. He may want to see your drivers license or make a copy of it as that firearm will need to be entered in his "bound book", and that requires "knowing where the firearm came from". The FFL will then ship your firearm to the other 'dealer', after he has received a certified copy of that dealers FFL. The dealer (FFL) that shipped will keep that certified copy of the receiving dealers license for his records and to be able to complete his "bound book" (where that firearm went). The shipping FFL will include a certified copy of his license with the firearm, so the receiveing FFL can enter it into his "bound book" (where that firearm came from). You have no need for a copy of the receiving dealers license,,, you transfered that firearm, face to face, to the dealer that shipped for you. The responsibility for a 'legal' shippment of that firearm has now been passed on to him (the FFL who ships for you). It don't get no easier than that!
